Class A Felony New York Penalties
- Imprisonment of 15 to life up to 25 to life is mandatory in New York State prison. (PL 60.05 (2), PL 70.00).
- A fine of up to $5,000 or double the gain from the crime (PL 60.05(7) and 80.00)
- Mandatory surcharge of $300 and a crime victim assistance fee of $25, unless restitution or reparation has been made. (PL 60.35(1)(a)(i); PL 60.35(6))
- Restitution or reparation. (PL 60.27(1); CPL 420.10(8))
- If the defendant has committed this offense and is convicted of a sexually motivated felony pursuant to PL 130.91, a life sentence or life without parole is mandatory. (PL 70.80(3))
- If a hate crime, the minimum period of the indeterminate sentence must be at least 20 years. (PL 485.10(4) and Penal Law 70.00(2-3))
- If a crime of terrorism, the sentence shall be life imprisonment without parole. (PL 60.06 & 490.25(2)(d))
