Class A2 Felony New York Penalties (Drug Cases)

• Imprisonment of 8 to 20 years is mandatory in New York State prison. (PL 60.04(2) & 70.71(2)(b)(i)).
• Post-release supervision for 5 years (PL 70.71(2)(b) & 70.45(2))
• CASAT ( PL § 60.04(6)) (Comprehensive Alcohol and Substance Abuse Treatment) See PL 60.04(6) and Corrections Law 2(18).
• Fine of up to $100,000 or double the gain from the crime (PL 60.05(7) and 80.00) and PL 60.01(3)(b)
• $300 surcharge, crime victim assistance fee of $25 dollars, unless restitution or reparation has been made. PL 60.35(1)(a)(i); PL 60.35(6).
• Drivers’ license and registration suspension for 6 months.  The suspension need not be imposed if the court finds compelling circumstances warranting an exception. VTL 510(2)(b)(v).
• Restitution or reparation (PL 60.27(1); CPL 420.10(8), PL 60.27(8); CPL 420.10(8))
• $50 DNA databank fee
