Non-violent
- Incarceration of 1 to 3 years minimum, 5 to 15 years maximum in New York State prison
- Probation for 3, 4, or 5 years (PL 60.01, PL 65.00)
- Interim probation supervision
- Conditional discharge for 3 years (PL 60.01, 65.05, 65.05)
- Unconditional discharge (PL 60.01, 65.20)
- Fine up to $5,000
- Surcharge
Violent
- Incarceration in New York State prison is mandatory. The minimum is 3.5 years, the maximum is 15 years.
- Post-release supervision of 2.5 to 5 years
- Fine of up to $5,000
- $300 Surcharge
- If terrorism, hate-crime, domestic violence, or the victim was a for-hire vehicle, special sentencing applies (see PL 490.25, 485.10, 60.12, PL 60.07)
